1. Acceptance of Terms
By engaging in court-mandated or legal services with Vivus Counseling Services, you agree to comply with these Terms & Conditions and all applicable laws, including Colorado Revised Statutes, relevant federal laws, and Behavioral Health Administration (BHA) policies.
2. Scope of Services
Vivus Counseling provides court-mandated and legal services including but not limited to:
- Domestic violence evaluations and treatment (DVOMB-approved)
- Substance use Evaluations and treatment
- Forensic evaluations
- Mental Health Evaluations Treatments
- Parenting classes
- Court-required compliance reporting
3. Confidentiality and Privacy
- Vivus Counseling complies with HIPAA, 42 CFR Part 2 (when applicable), Colorado privacy laws, and BHA confidentiality requirements.
- Information will only be shared with courts, probation, parole, DHS, or other agencies with your signed Release of Information (ROI) or when legally required.
- Mandatory reporting applies in cases of threats of harm to self or others, child or elder abuse, or court orders.
4. Fees and Payments
- Legal and court-mandated services are fee-for-service unless otherwise arranged.
- Payment is due as outlined in your client service agreement.
- Sliding scale fees may apply for qualified clients with verified financial hardship.
- Non-payment may result in suspension of services and notification to the referring agency or court.
5. Attendance and Compliance
- Clients must attend all scheduled sessions and comply with treatment plans and recommendations.
- Attendance and participation will be reported to the referring agency or court.
- Non-compliance (including repeated absences or refusal to follow treatment plans) will be documented and reported, which may affect your legal case.
6. Reporting to Courts and Agencies
Vivus Counseling will provide progress reports, compliance updates, and discharge summaries to the referring court, probation officer, or agency as required. Reports will include:
- Attendance records
- Participation and compliance status
- Treatment progress and recommendations
7. Client Rights
Clients have the right to:
- Be treated with dignity and respect
- Understand the purpose and requirements of court-mandated services
- Receive clear information about fees and financial responsibilities
- File a grievance if concerns arise, in accordance with Vivus Counseling’s grievance procedures and BHA policies.
8. Dispute Resolution
If you disagree with treatment recommendations or service requirements, you may submit a written request for review to Vivus Counseling Administration. We will address your concerns promptly in compliance with Colorado and BHA guidelines.
9. Changes to Terms
Vivus Counseling reserves the right to update these Terms & Conditions to remain compliant with Colorado law, federal law, and BHA policy. Updated terms will be posted on our website.
